Terms of Service

1. Overview
These Terms of Service (the "Terms") govern your access to and use of Savvy Spender and related websites and services (collectively, the "Services"), provided by Remarkable Systems, Inc. ("RSI", "we", "us"). By creating an account, installing the app, or using the Services, you agree to these Terms.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under 18, you represent that you have consent from a parent or guardian.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify RSI immediately of any unauthorized use.
If you contact RSI to request support or troubleshooting, you authorize RSI’s support personnel to access your account and related information as reasonably necessary to investigate, diagnose, and respond to your request.
4. Acceptable Use
- No illegal, infringing, or harmful content.
- No reverse engineering, scraping, or bypassing security controls.
- No reselling or sublicensing without RSI’s written permission.
5. Your Content
You retain full ownership of the images, notes, and other data you upload to the Services ("Your Content"). By using the Services, you grant RSI a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify (e.g., to run automated extraction), and store Your Content solely for the purpose of providing and improving the Services for you.
6. Subscriptions, Scan Allowances, Trials, and Payments
Some features are offered via paid subscriptions, and some features may be limited by plan-based usage allowances (including a monthly allowance of automated extraction "scans"). Taxes may apply. Payments are processed by authorized payment providers (e.g., the Apple App Store, Google Play, or Amazon Appstore). Cancellation takes effect at the end of the current billing period, and you will retain access until the period ends.
6.1 Definition of a "Scan"
A "scan" means one automated extraction attempt in which Savvy Spender processes a receipt or income image using our automated systems and returns extracted data. Each extraction attempt counts as one scan, including retakes, retries, re-uploads, and resubmissions of the same document. If you choose to "try again" for improved results, additional scans will be deducted from your plan allowance.
6.2 Usage Limits and Allowance Reset
Each subscription plan (and some free or promotional access) may include a monthly scan allowance. Unless explicitly stated otherwise, unused scans do not roll over to future months. When you reach your monthly allowance, scanning may be unavailable until your allowance resets at the start of your next billing period or until you purchase additional scans if offered.
6.3 Trials and Promotions
We may offer free trials or promotional access. Trials or promotions may end upon reaching usage limits (for example, a number of scans) or upon reaching scheduled time limits, whichever occurs first.
6.4 Plan Changes and Pricing
Plan prices, features, and usage allowances may vary by platform, region, and currency and may change over time. Any changes to a plan or pricing are handled through the applicable app marketplace and will apply as permitted by that marketplace’s rules and policies.
6.5 Refunds
Refund requests are subject to the policies of the marketplace through which you purchased the subscription (for example, Apple or Google). RSI does not directly process refunds for marketplace purchases.
7. Intellectual Property
Savvy Spender, including its software, text, images, logos, and data models, are owned by RSI or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the app for personal or business expense tracking in accordance with these Terms.
8. AI and Data Handling
The app may use machine learning/AI and related automation to extract information from images of receipts and paychecks. Output may be inaccurate or incomplete and is provided on an AS-IS basis. You are responsible for verifying results before relying on them. See the Privacy Policy for how we process data.
9. Third-Party Services
The Services may integrate with third-party platforms (e.g., cloud storage, payment processors, analytics). Those services are governed by their own terms and privacy policies.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. RSI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RSI DOES NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, ERROR-FREE, SECURE, OR UNINTERRUPTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. RSI’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO RSI FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD $100, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold RSI harmless from any claims arising out of your use of the Services, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access for any breach of these Terms or to protect users or the Services. You may stop using the Services at any time. Sections intended to survive termination will survive.
14. Changes
We may update these Terms from time to time. Material changes will be notified via the app or email. Continued use after changes means you accept the updated Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Disputes will be resolved in the state or federal courts located in Missouri, and you consent to their jurisdiction.
